Skrastiņš & Dzenis team has represented AS Latvijas gāze in a damages case against Financial Capital and Market Commission where our client has taken an action to claim from the FCMC interest from the deposit – the part of damages suffered as a result of insufficient supervision over AS Latvijas Krājbanka.

This was first case of a kind in Latvia where in case of failing bank going bankrupt which has caused a loss of deposit, the client of the bank filed a damages case against the supervising authority claiming that the authority has not exercised a prudent supervision of the relevant credit institution, which lead to grave consequences and loss of deposits by the clients.

Skrastiņš & Dzenis team, inter alia, has drafted the statement of appeal and represented the client during court hearings. The final judgement entered into force in January 2017.
