Skrastiņš & Dzenis has successfully represented a client in a case against the Latvian Competition Council

In the aftermath of the infamous Samsung cartel case, where the Latvian Competition council back in 2009 delivered an infringement decision and imposed on cartel members a record amounts of fines, our law office has successfully represented a client operating shops with the Tehnoland trademark in a novel case against the Latvian Competition Council where the Competition Council has attempted to apply the inevitability of liability principle and has issued an executive order in attempt to collect from the client a fine previously imposed on another legal person, which has ceased to exist.

As a result, on 5 June 2014 Riga Administrative district court has declared illegitimate and repealed the mentioned executive order on procedural grounds.
