Flylal vs Air Baltic: waiting for preliminary ruling to ECJ

On May 15 the Senate at the Supreme Court has delivered a decision to refer four questions to the ECJ for preliminary ruling in the case of recognition and enforcement of the judgement of Lithuanian court in Latvia where Skrastiņš & Dzenis continues to represent the former national airline of Lithuania.

As reported previously, our client has an ongoing litigation in Lithuania where it has filed a damages claim of over 57,4 million Euros in Lithuanian courts for abuse of a dominant position and illegal agreements restricting competition from the Latvian air carrier AirBaltic and Riga International Airport and within the damages case has applied to Latvian courts for recognition and enforcement of the Lithuanian court judgement to secure the claim and arrest assets of the respondents located in Latvia.
